These documents establish website rules and disclosures but cannot prevent every claim or replace advice from a lawyer familiar with the Site Operator’s circumstances and applicable state law.
1. Acceptance of these Terms
These Terms of Use (“Terms”) form an agreement between you and USACitizenshipTest.com (the “Site Operator,” “we,” “us,” or “our”) concerning your use of this website, its practice tests, guides, software and related materials (collectively, the “Service”). By accessing or using the Service, you represent that you have read, understood and agreed to these Terms and to the Privacy Policy and Disclaimer.
2. Educational service only
The Service is an independent educational resource. It is not operated, approved, endorsed or sponsored by U.S. Citizenship and Immigration Services (“USCIS”), the Department of Homeland Security or any other government agency. The Service does not provide legal advice, immigration advice, legal representation or an official determination of eligibility.
Practice questions use a multiple-choice learning format. The actual naturalization civics test is administered orally by USCIS. A score, completion record or result produced by the Service does not guarantee any result in an interview, examination, application or immigration proceeding.
3. Accuracy and changing information
We seek to provide useful and accurate educational material, but laws, procedures, test versions, government officials, local answers and official guidance can change. We do not warrant that every item is complete, current, error-free or suitable for your individual circumstances. You are responsible for confirming current information with USCIS and other official government sources.
4. Eligibility and minors
You may use the Service only if you can lawfully agree to these Terms. The website is intended primarily for people preparing for naturalization and for educators or family members assisting them. It is not directed to children under 13. A child under 13 should use the Service only with the involvement and supervision of a parent or legal guardian.
5. Limited permission to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable permission to access and use the Service for personal, non-commercial education. You may print reasonable portions for personal study. No ownership interest is transferred to you.
6. Prohibited conduct
You may not: interfere with the operation or security of the Service; attempt unauthorized access; introduce malicious code; use automated tools to overload, scrape or systematically extract the Service except as permitted to ordinary search engines; copy or republish substantial original website content as a competing product; misrepresent an association with the Site Operator or a government agency; remove notices; use the Service unlawfully; or assist another person in doing any of these things.
7. Intellectual property and government materials
The website’s original design, software, organization, explanations, selection of practice options and original editorial content are protected by applicable intellectual-property laws. Certain facts, official questions or materials originating from the U.S. federal government may be public-domain material under U.S. law. Government-origin material may still be subject to restrictions involving seals, insignia, trademarks, attribution or false endorsement. No government name, seal or symbol displayed or referenced on this website indicates endorsement.
8. Browser storage and progress
The Service stores unfinished sessions, answers and progress locally in your browser. This information may be lost if you clear browser data, change browsers or devices, use private browsing, or if the device or browser fails. We are not responsible for lost local progress or inability to restore a session.
9. Analytics, advertising and affiliate links
The Service records a minimal first-party usage event when a test starts and when that same test finishes, plus a broad desktop or mobile category. This aggregate measurement does not contain answers, scores, names, email addresses, IP addresses or location.
The Service also uses Extreme Tracking and Google Analytics for analytics and may use Google AdSense to display advertisements. These providers may process online identifiers and technical or usage information through cookies, pixels, scripts, IP addresses or similar technologies as described in the Privacy Policy.
Some banners or links may be affiliate links. If you follow one and complete a qualifying action, the Site Operator may receive compensation without increasing the price charged to you. Advertising, sponsored placements and affiliate relationships do not constitute our endorsement of the advertiser, product or service.
We use analytics to improve the Service and do not sell analytics information or operate a data-broker service. Advertising providers may use information for ad delivery, measurement, fraud prevention and, where permitted by your choices and applicable law, personalization.
10. Availability and changes
We may modify, suspend, restrict or discontinue any part of the Service at any time. We may correct errors, change practice logic, update content or block access when reasonably necessary for security, legal compliance or protection of the Service. We do not guarantee uninterrupted availability.
11. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” The Site Operator disclaims all express, implied and statutory warranties, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, availability and results. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by applicable law, the Site Operator and its contributors, service providers and representatives will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of data, loss of progress, loss of opportunity, immigration consequences, application outcomes, lost profits or reliance on website content.
To the fullest extent permitted by law, the total aggregate liability arising from the Service will not exceed the greater of US $100 or the amount you paid directly to the Site Operator for the Service during the six months preceding the event giving rise to the claim. Some jurisdictions do not permit certain exclusions or limits, so portions of this section may not apply to you.
13. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless the Site Operator and its contributors and service providers from claims, liabilities, losses and reasonable costs arising from your unlawful use of the Service, material breach of these Terms or infringement of another person’s rights. This obligation does not apply to the extent a claim was caused by the Site Operator’s own unlawful conduct.
14. Governing law and disputes
These Terms are governed by applicable laws of the United States and applicable state law, without giving effect to conflict-of-law rules, except where mandatory consumer law requires otherwise. Any dispute must be brought before a court of competent jurisdiction in the United States that has lawful personal and subject-matter jurisdiction. Nothing in this section prevents either party from seeking appropriate emergency or injunctive relief.
15. General provisions
If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent. These Terms, the Privacy Policy and the Disclaimer constitute the entire agreement concerning the Service unless a separate written agreement applies.
16. Changes and contact
We may update these Terms to reflect changes in the Service, law or risk. The revised effective date will appear at the top of this page. Continued use after an update means you accept the revised Terms to the extent permitted by law.
